Law Commission of India submits report

The Law Commission of India submitted a report to the government on setting up of new courts in the country to clear the ever increasing pendency of cases. The report is based on a study by the Commission on manpower planning in the judiciary .
Speaking after submission of the report to law minister Ravi Shankar Prasad, panel chief Justice Ajit Prakash Shah said the Commission has tried to use scientific formula to the extent possible to estimate the number of judges needed all over the country . Justice Shah said the report would help the government on the number of judges required to dispose of the backlog in a three-year time frame. He has also recommended increasing the retirement age of subordinate judges to 62.
The panel suggested setting up of special morning and evening courts for dealing with traffic challan cases which constitute 38.7% of the total cases and 37.4% of all pending cases in the past three years.
Justice Shah said HCs be directed to evolve uniform data collection and data management methods in order to ensure transparency and to facilitate data-based policy prescriptions for the judicial system. He suggested application of good judicial management practices such as putting into place timeliness and performance benchmarks as among other measures for reducing pendency .
