RaGa goofs up too


The Election Commission is discussing possible action over Congress leader Rahul Gandhi’s presence in at least three polling booths in Amethi. This could include immediate suspension of election officials of the said polling stations, and even writing to their respective departments after the polls seeking disciplinary action against them for failing to discharge duties and violating the election rules.
As per rules, it is the responsibility of the presiding officer to ensure that no person other than the voter, polling officer and presiding officer himself enters the voting compartment where the EVM is kept.
However, any action against Rahul would depend on whether he was inside the voting compartment while an elector was in the process of voting. According to an EC source, though Section 128 of the Representation of the People Act relates to violation of secrecy of voting, it is specifically with respect to poll-related officials including officers, clerks, agents or any person involved in recording of counting of votes.
Penalty for violating this provision is a jail term of up to three months or fine or both. “A candidate may not automatically invite this provision. Of course, the voter who may have voted in presence of the candidate could file a complaint, alleging violation of secrecy of his vote or even intimidation,” a Commission official pointed out.
