Of Partial Acceptance !!



The Congress-NCP government in Maharashtra decided not to press new criminal charges against politicians indicted by the Adarsh inquiry commission for violation of rules while granting various clearances to the infamous housing society. The CBI is already probing the case. The state government, at its cabinet meeting, decided to accept the Adarsh inquiry commission’s report partially and admitted that many rules were violated while granting permissions to the promoters of the Adarsh society to build a 31-storey building in Mumbai’s Colaba area.


Chief minister Prithviraj Chavan announced that the state cabinet briefly discussed the Adarsh report in its weekly meeting and decided to accept it partially. The state cabinet had earlier on December 20 rejected the judicial commission’s report. Then, Congress Vice President Rahul Gandhi had expressed his displeasure and suggested that the decision should be reviewed.
“Six politicians have been named in the Adarsh commission report as those who provided patronage to the Adarsh society. There will be no new cases filed against any of these political leaders. There is a Supreme Court guideline which has been mentioned in many cases that in one case only one FIR can be filed. Since CBI has already filed an FIR in this case and is pursuing the investigation, the state government does not plan to file any fresh cases or FIR in Adarsh. The investigation of some flats being benami or some documents being fraudulent will be done by the CBI itself”, Chavan added. “Several violations have been found in the granting of permissions to Adarsh society including environmental
clearances. The state government had claimed that the land belongs not to defence but to the state government, this has been upheld by the commission. Twelve public servants were found to be involved in violations of norms. A departmental inquiry against all these will be initiated,” Maharashtra CM Prithviraj Chavan told reporters.
Former chief ministers Vilasrao Deshmukh, Ashok Chavan, Shivajirao Nilangekar and Sushilkumar Shinde were accused of giving out of turn-clearances to the society. NCP leaders Rajesh Tope and Sunil Tatkare were also named by the inquiry commission.
